On this page

These Terms of Service (“Terms”) govern your access to and use of Heirloom, including heirloom.2bl.ai, related applications, features, tools, and services (collectively, the “Service”).

The Service is operated by Jeff Lougheed, carrying on business as Second Brain Labs and operating the Heirloom service (“Heirloom,” “we,” “us,” or “our”).

By accessing or using Heirloom, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

01What Heirloom does

Heirloom helps people capture, develop, organize, preserve, share, and publish stories and memories.

The Service may allow you to participate in guided conversations and prompts; enter or upload stories, facts, dates, names, photographs, documents, audio, and other material; use AI-assisted tools to help organize, draft, edit, summarize, or develop stories; collaborate with or receive contributions from other people; create collections of stories; create shareable digital experiences; and create and order printed books and other physical products based on your content.

Heirloom is a tool for helping you create and preserve stories. We do not independently verify the truth, accuracy, ownership, or completeness of material provided by users.

02Eligibility

You must be at least 16 years old to create an account or use the Service.

If the law where you live requires you to be older than 16 to enter into these Terms without parental or guardian consent, you may use the Service only if the required consent has been obtained.

You must be legally capable of entering into a binding agreement.

03Accounts

You agree to provide accurate information when creating an account and to keep that information reasonably current.

You are responsible for maintaining the security of your account and credentials and for activity conducted through your account. You may not use another person’s account without permission.

You should notify us promptly at hello@2bl.ai if you believe your account has been accessed without authorization.

04Your content belongs to you

You retain ownership of the content you create, provide, or upload to Heirloom.

This may include stories, photographs, recordings, documents, comments, facts, names, dates, memories, and other material you submit to the Service (“User Content”).

Using Heirloom does not transfer ownership of your User Content to us.

05Licence you give Heirloom

To provide the Service, you grant Heirloom a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, format, adapt, transmit, display, and otherwise use your User Content only as reasonably necessary to:

  • operate and provide the Service;
  • process and organize your stories;
  • provide AI-assisted features;
  • display your content to you and people you authorize;
  • create digital or physical outputs you request;
  • send material to printing or fulfillment providers;
  • maintain, secure, and troubleshoot the Service; and
  • comply with legal obligations.

This licence does not transfer ownership of your User Content to us.

Except where reasonably necessary for backups, legal obligations, security, fraud prevention, or content already distributed at your direction, this licence ends when the applicable User Content is deleted from the Service.

06Content about other people

Stories and memories frequently involve other people.

You are responsible for the User Content you submit, publish, share, or include in a book or other output.

You agree not to knowingly use Heirloom in a way that unlawfully violates another person’s copyright, privacy, publicity or personality rights, trademark, confidentiality rights, or other legal rights.

If you upload photographs, recordings, documents, or other material created or owned by someone else, you represent that you have the rights or permissions reasonably necessary to use that material.

07AI-assisted features

Heirloom uses artificial intelligence and automated technologies to help users work with their stories and content.

These features may help draft, organize, summarize, edit, structure, suggest, format, or otherwise transform User Content.

AI-generated or AI-assisted material may contain errors, misunderstand context, omit important information, or produce language that does not accurately reflect your intent.

You are responsible for reviewing and approving the final content you choose to keep, publish, share, or print. Heirloom does not guarantee that AI-assisted content is historically accurate, factually complete, or an authoritative account of an event.

Our Privacy Policy explains how your content is processed by our AI providers.

08Sharing and contributors

Heirloom may allow you to invite other people to contribute information, stories, memories, photographs, or other material.

You are responsible for deciding who you invite and what access you provide.

If another person contributes material to your project, that person is responsible for the material they provide and for having the necessary rights to provide it.

You are responsible for reviewing the final story, collection, or book before you publish, share, or order it.

Once material has been shared, copied, printed, or otherwise distributed outside Heirloom, we cannot control what happens to that copy.

09Printed books and physical products

When printed books become available, Heirloom may allow you to create and purchase printed books or other physical products based on your User Content.

Printing and fulfillment may be provided by independent third-party printers, manufacturers, marketplaces, logistics providers, or fulfillment partners.

By placing an order, you authorize us to provide the content and information reasonably necessary to those providers to produce and deliver your order.

You are responsible for reviewing and approving the content, spelling, names, photographs, layout, and other information before submitting a final order.

Printed products may have reasonable variations in colour, cropping, alignment, paper, binding, reproduction quality, or other physical characteristics resulting from printing and manufacturing processes.

Production and delivery estimates are estimates and are not guaranteed.

Heirloom is not responsible for delays caused by printing providers, carriers, customs, supply interruptions, weather, or other circumstances outside our reasonable control.

If a printed product arrives materially defective, damaged, or materially different from the approved order, contact us at hello@2bl.ai. Refunds, reprints, or other remedies will be handled in accordance with the policy presented at the time of purchase and applicable law.

10Payments

When paid features become available, Heirloom may offer paid subscriptions, printed books, physical products, or other paid features.

Before completing a purchase, you will be shown the applicable price and material purchase terms.

Prices may include or exclude applicable taxes and shipping depending on your location and the product being purchased.

Payments may be processed by third-party payment providers. Additional payment-provider terms may apply.

If Heirloom introduces recurring subscriptions or other recurring charges, the applicable renewal, cancellation, billing, and refund terms will be disclosed before you subscribe.

11Account deletion

You may stop using Heirloom at any time.

To delete your account and the content associated with it, email hello@2bl.ai from the address on your account and we will process the request. Some information may remain in backups for a limited time or where we are required to keep it.

12Acceptable use

You may not use Heirloom:

  • for unlawful, fraudulent, abusive, or harmful purposes;
  • to violate another person’s rights;
  • to upload malicious software or code;
  • to gain unauthorized access to systems or accounts;
  • to interfere with the Service;
  • to scrape or systematically extract data without permission;
  • to reverse engineer or attempt to obtain source code except where applicable law expressly permits it;
  • to impersonate another person unlawfully; or
  • to use the Service in violation of applicable law.

We may remove content or restrict, suspend, or terminate access where we reasonably believe these Terms have been violated or action is necessary to protect users, Heirloom, or others.

13Heirloom intellectual property

Except for User Content, Heirloom and its licensors retain ownership of the Service, including software, interfaces, designs, branding, trademarks, technology, documentation, and other materials created by or for Heirloom.

You receive a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.

14Feedback

If you voluntarily provide feedback, suggestions, ideas, or recommendations about the Service, you permit us to use them to develop and improve Heirloom without compensation or obligation.

This does not give us ownership of your stories, photographs, recordings, or other User Content.

15Third-party services

Heirloom relies on third-party providers to operate.

These currently include Vercel, Supabase, Clerk (including sign-in with Google), Anthropic, and Deepgram.

Email sent to hello@2bl.ai passes through ImprovMX, a third-party email forwarding service, before it is delivered to us.

Additional providers may be used for printing, fulfillment, payments, communications, shipping, or other operational functions.

Our Privacy Policy explains how information may be processed by service providers.

16Service availability

Heirloom is an evolving product.

We may modify, add, suspend, or discontinue features.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. We also cannot guarantee that stored content will never be lost or corrupted.

You should retain independent copies of material that is particularly important to you when practical.

17Disclaimer of warranties

To the maximum extent permitted by applicable law, Heirloom is provided “as is” and “as available.”

We do not guarantee uninterrupted or error-free operation; permanent preservation of User Content; accuracy of AI-generated or AI-assisted material; accuracy of memories, stories, facts, dates, or other user-provided information; perfect reproduction in printed products; availability of third-party services; or that the Service will meet every user’s specific requirements.

Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.

18Limitation of liability

To the maximum extent permitted by law, Heirloom and Second Brain Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, opportunity, goodwill, or data arising from or related to the Service.

To the maximum extent permitted by law, our total aggregate liability arising from the Service or these Terms will not exceed the greater of:

(a) the amount you paid to Heirloom during the 12 months immediately preceding the event giving rise to the claim; or
(b) CAD $100.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

19Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Heirloom and Second Brain Labs from claims, losses, liabilities, damages, and reasonable costs arising from User Content you submit or publish, your unlawful use of the Service, your material breach of these Terms, or your violation of another person’s legal rights.

We will not seek indemnification from you for claims resulting solely from our own conduct.

20Suspension and termination

We may restrict, suspend, or terminate access to Heirloom where we reasonably believe these Terms have been materially violated, the Service is being abused, another person’s rights are being violated, there is fraud or a security threat, continued access creates material legal risk, or applicable law requires us to act.

Where reasonably practical, we will provide notice before termination.

21Privacy

Our collection, use, storage, processing, and disclosure of personal information is governed by our Privacy Policy.

Because Heirloom is designed to store personal stories and memories, User Content may contain sensitive or highly personal information. Please review the Privacy Policy before deciding what to provide to the Service.

22Changes to these Terms

We may update these Terms as Heirloom evolves.

If we make material changes, we will provide reasonable notice where required by law.

Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.

23Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Subject to mandatory rights you may have under the law where you live, disputes relating to the Service or these Terms will be subject to the courts of Ontario, Canada.

Before commencing formal proceedings, both parties agree to make a reasonable good-faith effort to resolve the dispute directly.

24International users

Heirloom may be used internationally.

If you use the Service outside Canada, you are responsible for complying with laws applicable to you.

Nothing in these Terms is intended to waive consumer, privacy, or other rights that cannot legally be waived under applicable law.

25General

If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

We may transfer these Terms in connection with an incorporation, financing, reorganization, acquisition, sale, or transfer of Heirloom or substantially all of its business or assets, subject to applicable law.

These Terms, together with our Privacy Policy and any specific purchase terms presented to you, constitute the agreement governing your use of Heirloom.
